Federal Court Enforces Franchisee’s Post-Termination Obligations and Awards Franchisor its Legal Fees

In the face of a franchisee’s claim that he was entitled to ownership of his customer data, our franchise litigation team secured an injunction against the franchisee, enforcing a post-termination non-compete provision, enjoining use of the franchisor’s trademarks, and restraining the franchisee from using the customer data generated from his franchise location. The franchisee was also ordered to pay the franchisor’s attorneys’ fees in securing the injunction. Jim Susag led the team and argued the injunction motion.
