Injunctions in the Franchising Context
In the October 2007 Law Journal Newsletter - Franchising Business & Law Alert, Jon Swierzewski co-authors a two-part article discussing the differences in Canadian and American procedures regarding injunctions in the franchising context.
The article discusses how franchisors may need to seek injunctions to enforce non-competition and other covenants contained in their franchise agreements, sometimes during but most often after the end of the franchise relationship. Recognizing the key role played by injunctions in franchise litigation, this article contrasts the procedures and the substantive arguments used to obtain injunctions in Canada and the United States.
