Just over a few months ago, the United States Supreme Court began its 2008 term. In a previous alert, we provided a brief look at some of the interesting cases the Supreme Court agreed to hear. Since the Supreme Court continues to accept new cases throughout the term, this alert provides a look at some of the cases that have been added to the Court’s docket.
OSHA Issues Final Rule Regarding Personal Protective Equipment Violations

On December 12, 2008, the Occupational Safety and Health Administration (“OSHA”) issued its final rule clarifying an employer’s duty to provide personal protective equipment and to train each of its employees on the proper use of the equipment.
$54 Million Settlement Reached in Minnesota Class Action Suit Against Wal-Mart

In December 2008, Wal-Mart Stores, Inc. (“Wal-Mart”) agreed to pay over $54 million to settle a wage and hour class-action lawsuit that alleged Wal-Mart forced its hourly employees to work through their rest breaks without pay.
