On November 4, Larkin Hoffman hosted the annual Minnesota Surety Conference in association with the Minnesota Surety Association. Leaders from across the industry met to discuss the challenges they are facing and how best to address them. Topics including cyber security, insurance and response plans, succession planning, and change orders were discussed this year. Inga Kingland and Dave Hammargren moderated the event which featured presentations by Chris Yetka and Patrick Cole of Larkin Hoffman, Joe Kingland of Blue Team Alpha and Alex McBride of Wipfli.

Eighth Circuit Affirms Insurance Bad Faith Award Obtained by Christopher Yetka and Sarah Greening, Among the First in Minnesota Federal District Court
On August 30, 2021, the Eighth Circuit Court of Appeals affirmed a finding of bad faith against Selective Insurance Company of South Carolina. Selective had accused a homeowner of fraud when he brought a claim for hail damage following a storm in 2015. The unfounded accusation of fraud arose because the policyholder’s home had been hit by a storm in 2010, the policyholder was paid for the earlier damage, and made representations about what was and was not repaired after the earlier storm.

Hollydale Golf Course: The Complex Road to Redevelopment Approval
The redevelopment of any large land area can be very difficult to accomplish, especially when it is surrounded by homeowners who like the status quo. This is especially true when the conversion involves a golf course: pastoral, quiet, well-landscaped (maybe a few stray golf balls). The surrounding landowners (most often homeowners) understandably love the open space, the seasonal nature of the sport and the relative quiet they experience as a neighbor. However, the redevelopment of golf courses has been occurring with some regularity for the past 20 years throughout the country as demographics and loyalty to the sport has changed. Throughout Minnesota, and certainly throughout the metro area of Minneapolis-St. Paul at least a dozen golf courses have been closed and redeveloped, sometimes multiple courses in the same city.
