Resolution of Dispute Over Lease Modifications


When a property owner needed litigation support to evict a tenant, the company turned to Larkin Hoffman. The client, who owns and manages properties throughout Minnesota and numerous other states, sought to evict a tenant from its restaurant space in the client’s headquarters for non-payment of rent. What seemed to be a straight-forward case quickly developed into a larger dispute when the tenant claimed that the client agreed to reduce the payment amount due under the lease. Larkin Hoffman attorney Julie Nagorski assisted as co-counsel in preparing the testimonial and documentary evidence showing that no such modification occurred. Following a trial, the court issued a decision allowing the client to evict the tenant and found that the tenant owed in excess of $200,000 in past-due rent.
