Successful Involuntary Bankruptcy Conversion


Alex Beeby successfully obtained an involuntary bankruptcy conversion to avoid the discharge of a debt owed to our client. While trying to collect on a judgment debt, our client received notice that the debtor filed for bankruptcy. Because the debtor filed under Chapter 13, the debt in question would have been discharged. Over the debtor’s objections, Alex convinced the court to convert the case to a Chapter 7 case. The debt is not discharged in Chapter 7. In addition, our client will receive his share of any funds collected by the Chapter 7 trustee, including a receivable that the debtor was attempting to abandon.
