Wetland and Storm Water Permits for Residential Development

A large national residential developer selected Larkin Hoffman for representation in obtaining Clean Water Act and Minnesota Wetland Conservation Act permits from the U.S. Army Corps of Engineers and Rice Creek Watershed District to fill and excavate wetlands for a 123-unit residential development in Blaine, Minnesota. The Larkin Hoffman team also helped the developer obtain federal water quality certification from the Minnesota Pollution Control Agency and other required storm water authorizations. This work involved complex negotiations with multiple government agencies to reconcile differing regulatory requirements under the federal Clean Water Act and Rice Creek’s approved comprehensive wetland management plan.
