The legal landscape of non-compete agreements continues to shift, leaving many companies trying to figure out how to protect their business interests. On July 1, 2023, a Minnesota statute went into effect defining a non-competition agreement as any agreement that restricts or prohibits an individual from working for certain employers, or in a certain profession or geographic area. The goal of this statute was to remove barriers for someone trying to find another job and only pertains to employees who signed a non-compete agreement on or after July 1, 2023. Non-compete agreements signed before July 1, 2023 are still enforceable.
However, as MSBA Labor & Employment Law Specialist and Attorney Dan Ballintine discussed in a recent podcast, it is important for employers to understand the difference between non-compete agreements, non-solicitation agreements and confidentiality agreements – the latter two are still enforceable in Minnesota, and both are important tools employers can use to protect their businesses.
