Larkin Hoffman’s Chris Young was interviewed by Law360 for the publication’s coverage of the Federal Circuit’s recent decision in EcoFactor v. Google. The decision calls for a new trial on damages in the patent case and will likely impact expert testimony, particularly in the patent damages context.

Expanding on his analysis previously published on the Larkin Hoffman website, Young discussed “the concept that judges should prevent unreliable expert testimony from being admitted,” stating to Law 360:

"I think that the reminder was necessary because perhaps courts have become slightly more relaxed with respect to the gatekeeping function," he said. While each judge is different, "I do think that this is certainly going to lead to greater scrutiny about the factual bases for expert opinions," he said.
