Real Estate
Larkin Hoffman's real estate team advises clients on all aspects of real estate and every phase of real estate development – including acquisition, approvals, assembly, construction, financing, leasing, litigation and disposition of real estate.
Real Estate Litigation
Our real estate litigation team combines experience in real estate, land use, construction and environmental matters with expertise in litigation, dispute resolution and appellate advocacy. Specialty areas include eminent domain actions, property tax assessment and special assessment appeals, landlord-tenant disputes, and liens and mortgages.
Government Relations
Larkin Hoffman's government team represents clients as they engage with all levels of government: local, state and federal. We work with lawmakers, agency decision makers and local units of government to resolve issues for businesses, trade associations and nonprofit organizations. We lobby the Minnesota Legislature and state agencies, the Metropolitan Council, county boards, city councils and regulatory agencies on behalf of our clients to achieve successful government decisions.
Franchise Law
Larkin Hoffman’s franchise and distribution team use their deep industry experience to help clients gain an edge over their competitors. We advise franchisors of all shapes and sizes – from start-ups to sophisticated multinationals, bringing extensive knowledge not only of the law, but also of business issues unique to franchising. Over the years, our clients have included full-service and quick-service restaurants, service businesses such as dental offices, home inspection services, travel services, real estate services, and weight loss clinics, a variety of retail store concepts and hotels, and Internet-based businesses.
Land Use & Zoning Law
We represent both developers and government entities in all aspects of the land use process, including zoning and comprehensive plan changes, subdivision and preliminary plat approvals, planned unit developments, conditional use permits, interim use permits, variances, and business licensing, public finance, government relations and enforcement. We assist clients contemplating development opportunities by streamlining the process and negotiating the approvals necessary to get the project done.
Eminent Domain and Inverse Condemnation
When private property is taken for a public purpose in the condemnation or eminent domain process, the owner has the constitutional right to receive payment of “just compensation” for the surrendered property and a right to be compensated for relocation costs under state and federal regulations. The owner also has the right to an independent appraisal to determine the fair market value of the property and the right to reimbursement of certain appraisal costs.
Environmental Law
The Larkin Hoffman environmental regulation practice group has substantial experience in environmental regulatory and permitting matters as well as environmental litigation. Our experienced lawyers handle environmental impact statement preparation and processing, alternative urban area-wide review, the Minnesota Wetland Conservation Act, Department of Natural Resources and Army Corps of Engineers permitting and litigation of environment-related disputes.
We assist developers in the zoning and approval process, ensuring that appropriate environmental reviews are completed and the proper permits are secured. Our knowledgeable team ensures compliance with the constantly changing regulatory framework involved in this field. Our experienced team of litigators stands ready to handle any environmental dispute, whether in an administrative contested case hearing, in district court or before the Minnesota Supreme Court. We provide definitive analysis, practical solutions and persuasive advocacy.
Estate Planning and Probate
We provide counsel to individuals, families, professionals and closely-held entities regarding estate planning as well as the financial, tax and business law issues which are often related to estate planning and administration.
Commercial Litigation
Commercial transactions and relationships produce conflicts that can threaten or disrupt business activities. When this occurs, our business litigation practice group ensures that the interests of our clients are protected.
